Maa Indra Digital – DMCA Policy

Maa Indra Digital (“we”, “our”, “us”) respects the intellectual property rights of artists, creators, and copyright owners. We comply with the Digital Millennium Copyright Act (“DMCA”) and other applicable copyright laws. This DMCA Policy explains how copyright owners can report infringement, how users can respond, and how Maa Indra Digital processes takedown requests.

1. DMCA Compliance

Under the DMCA, we are required to:

  • Respond promptly to valid copyright complaints
  • Remove or disable access to infringing material
  • Notify the user who uploaded the content
  • Allow the uploader to submit a counter-notice if they believe the claim is mistaken
  • Handle disputes in accordance with applicable copyright laws

Maa Indra Digital does not tolerate copyright infringement.

2. What Is Copyright Infringement?

Infringement occurs when someone distributes music, artwork, or other copyrighted content without proper permission from the rightful owner. Examples of infringing uploads include:

  • Songs owned by another artist or label
  • Remixes, mashups, or edits without licenses
  • Unlicensed samples or beats
  • Cover songs without required mechanical licenses (where applicable)
  • Stolen artwork, logos, or images
  • Unauthorized use of another artist’s voice, name, or likeness
  • Audio taken from movies, TV, or online videos without permission

Any such content may be removed immediately.

3. How to File a DMCA Takedown Notice

If you believe that your copyrighted work is being distributed through Maa Indra Digital without authorization, you may submit a DMCA takedown notice.

3.1 Required Information

Your DMCA notice must include the following (as required under DMCA §512(c)(3)):

  • Your full legal name
  • Your contact information (email, postal address, phone number)
  • A clear description of the copyrighted work you claim has been infringed
  • Links (URLs) to the allegedly infringing content on digital platforms or our services
  • Proof of ownership (e.g., registration documents, contracts, or original files)
  • A statement: “I have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.”
  • A statement: “The information in this notice is accurate, and I am the copyright owner or authorized to act on behalf of the owner.”
  • Your electronic or physical signature

4. What Happens After You Submit a DMCA Notice

Once your DMCA notice is received and reviewed:

  • We verify whether the notice contains all required information.
  • If valid, we remove or disable access to the allegedly infringing content.
  • We notify the uploader about the takedown and provide them relevant details of the complaint, as required by law.
  • We may freeze or withhold royalties related to the disputed content until the matter is resolved.

5. Counter-Notification (If You Are the Uploader)

If you are the uploader of content that has been removed due to a DMCA notice and you believe the takedown is mistaken or that you have the right to use the material, you may submit a Counter-Notice.

5.1 Required Counter-Notice Information

Your Counter-Notice should include:

  • Your full legal name
  • Your contact information (email, address, phone number)
  • Identification of the content that was removed or disabled and where it appeared
  • A statement: “I have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.”
  • A statement that you consent to the jurisdiction of the courts in Patna, Bihar, India, and that you will accept service of process from the person who provided the original DMCA notice or their agent.
  • Any proof of your rights (contracts, licenses, ownership documents, etc.)
  • Your electronic or physical signature

6. After a Counter-Notice

After receiving a valid Counter-Notice:

  • We may forward the Counter-Notice to the original complainant.
  • If the complainant does not file a legal action within a reasonable period (typically 10–14 business days, subject to applicable law), we may, at our discretion and subject to DSP rules, restore the content.
  • If legal proceedings are initiated, Maa Indra Digital will follow the outcome of the court decision and may be unable to restore the content until case resolution.

7. Repeat Infringer Policy

Maa Indra Digital operates a strict repeat infringer policy. A user may be classified as a repeat infringer if:

  • We receive multiple valid DMCA notices against their uploads; or
  • There is clear evidence of repeated copyright abuse or fraud.

Consequences may include:

  • Permanent suspension or termination of the account
  • Withholding of unpaid royalties related to infringing content
  • Blocking of future uploads
  • Reporting to digital platforms and relevant authorities

8. Misuse of the DMCA Process

Submitting false or malicious DMCA notices, or misrepresenting your ownership, can have legal consequences. We strictly prohibit:

  • Fake copyright claims
  • Using DMCA to harass or attack competitors
  • Filing takedowns without good-faith belief of infringement

Users who abuse the DMCA process may face account action and legal liability.

9. Verification & Documentation Requests

Maa Indra Digital may request additional documentation to verify ownership or authorization, including:

  • Producer or writer agreements
  • Split sheets
  • Licensing or distribution agreements
  • Publisher or label confirmations
  • ISRC, UPC, or registration details

Failure to provide sufficient documentation may result in content takedown, rejection of Counter-Notices, or account action.

11. Changes to This DMCA Policy
